Billy Pilgrim as a Saint or Nutcase in Slaughterhouse Five Billy is a nut, hes just plain bonkers. For started Billy has a history of mental problems he has been institutionalized twice. The first time was when he father died this was while he was in training, before he went off to war. The second time was when he came back from the war. Plus he had the head injury from the plane crash. He only started talking about the Tralfamadorians after the plane. And its odd that every thing about the Tralfamadorians is from those good old Kilgore Trout novels. Now remember Billy first started to read Trouts novels when he committed himself, this was second time he was in the nut house it was after the war. Billy even knew he was crazy to be asking her. Isnt it odd that Billys Time Traveling only happens in stressful situations and moments? Billy seems to have no control over it. It seems like whenever things take a turn for the wors t Billy time travels to Tralfamador to get away from it all. In Tralfamador all of his needs are taken care of. Tralfamador is a fantasyland for Billys. On Tralfamador Billy has this knockout wife, Montana. Yet Montana on Earth is a porno star, and Billy found out about her while in New York City at a porno bookstore. The whole wife thing just yells insanity! Billy is married to a woman who he finds physical unattractive so of course he would have thoughts of a woman who was beautiful as Montana, its like a guilty pleasure thing. It in deed makes sense for a man being that sexually deprived and unhappy and highly unlucky, to go crazy. You cant really live if your not happy, may be thats why Billy does not resist death, like a normal person would. So heres what I think, Billy is a crazy nutcase! Whenever the real world gets too hard he time travels to Tralfamador, hes little fantasyland where everything is wonderful, and he has his Hollywood wife. Is Billy crazy? Tech schools tend to specialize in jobs for production and personal services because the teachers and majors available to these students are limited in terms of what they are able to teach and the education of the teachers. Some tech schools are even more specialized to a certain field. For example a school like pennco tech is mainly specified for automotive, students looking for a mechanic certification would be interested in a school like this. Another advantage of going to a tech school is that tuition and fees are much more affordable compared to a large university. This makes tech school more accessible than the majority of universities. This makes choosing a major considerably easier than a university because the student already knows what they want to do most likely before they arrive at the tech school. Ratcliff tech also has many disadvantages; the big disadvantage of going to a tech school is that their selection of courses is greatly diminished compared to a university. This is mainly because the school does not have the proper funding or education to offer a wide variety of majors. Teachers are often in demand at tech schools and these teachers are not as educated or as good of teachers as most university teachers. The other disadvantage of going to a tech school is they do not offer many jobs in the analytic services category because these jobs take much higher education and a lot more years of schooling. These jobs typically offer a much higher income than the jobs in the other two categories stated. Students have an option to go to tech school or a university. The advantages of going to a university in my mind greatly outweigh the advantages of going to a tech school. This is because at a university the average degree earns a student a much greater amount of money than the average tech school degree does. That is because there are more jobs in the analytic services category than any of the other categories. Jobs in this category are typically jobs like a CEO of a big fortune 500 company or someone who created a product and now is majority owner or chairman of the company. This is because these schoolââ¬â¢s offer a higher education and give the student the necessary tools to become a ceo or chairman. A university like mountainfeild also has many disadvantages too. Like any university the student will be in a much bigger community and they will not receive the specialized attention and education that a tech school will offer Them this can make or break certain students and also can give them a better chance in learning their major and field of choice, this is why many students at big universityââ¬â¢s tend to drop out or fail out because the course load or lack of individualized attention does not fit them well and the job categories that a tech school offers fit them a lot better than a large university does. Another disadvantage of a large university is that the school takes a lot longer to graduate from and in many fields in production and services there is no need for 4 years or even more worth of schooling when you can get it in two years or less at a tech school. The advantages and disadvantages of going to a tech school or a university make the decision very hard; this is why thousands and thousands of students have to make a tough decision every year. Tech schoolââ¬â¢s offer benefits in the short term but lack the education and degree that you would receive from a university, in the long run universityââ¬â¢s give back much more than any tech school can offer, a students future can depend on if they made the right decision and if this decision is a viable one for your future. Question: Discuss about the Law of Contracts. Answer: Step 1 In this case the legal issue in question is that whether there has been a formation of valid contract between the burger company and the two claimants Johnathon and Amanda according to the rule of offer and acceptance required to constitute a contract. Step 2 In the case of Carlill v Carbolic Smoke Ball Co Court of Appeal [1893] 1 QB 256; [1892] EWCA Civ 1 the defendant produced Carbolic Smoke Ball which were made to prevent the users from getting affected by influenza and other similar disease. The company has published an advertisement that they will reward 100 pounds to any person who gets affected by influenza or any such disease after taking using the smoke ball provided by the company for a specified period. The company deposited 1000 pounds in a separate bank out to show their sincerity towards the matter. With respect to the advertisement the claimant Mr. Carlill bought the smoke ball and used them according to the instructions and subsequently was affected by flu and made a claim for the reward. The smoke ball company refused to pay the rewards and was ultimately sued by the claimant. In this landmark case the court ruled that the claimant was entitled to get the rewards from the company. The court further provided that there existed a unilateral agreement which comprised the offer through an advertisement by the defendant and the acceptance by the claimant through the performance of the conditions of the offer. The plaintiff claimed that advertisement was a clear offer, as this was an offer in rem as soon as the offeree committed the act mentioned in the offer it let to the formation of the contract and the terms of the offer were clear to constitute a valid offer. The defendant claimed that the advertisement was unclear and vague to constitute an offer, there was no consideration in the offer and there was no communication of acceptance. In relation to the offer the court held that an offer can also be made to the world at large. The court held that the advertisement made by the company constituted an offer as it was evident by the action of the company (deposit of 1000 pounds in a separate bank account for the purpose) that it was not a sales puff. The court is this case also ruled that the language of the offer in this case was appropriately clear to make it enforceable. The court in this case ruled that even though according to a general rule it is required to communicate the acceptance to the offeror may opt out of the need for a notification expressly or implied as he has done in this case. In this case the offeror made it clear that the offeree did not have to communicate acceptance to offeror and the acceptance can be done through the performance of a particular action (use of smoke ball). With respect to consideration the court held that the consideration in this case was the problems suffered by the claimant through using the company product according to the direction of mentioned in the offer. Moreover the defendant had received proper benefits as people used more of their products due to the advertisement (Lambiris Griffin, 2016). According to the principles of revocation of an offer, an offer can be revoked any time through direct or indirect communication of the the notice of revocation by the offeror before an acceptance is made. This principle was discussed broadly in the case of Byrne v Van Tienhoven (1880) LR 5 CPD 344 Common Pleas Div where the court held that revocation requires communication. Step 3 Applying the lea gal principles discussed in step 2 it can be confirmed that advertisement made by the burger company comprised of a valid offer. This can be ascertained because the terms of the offer were clear. Although the terms of the offer stated limited time with respect to its validity, it was not too vague to challenge the existence of a valid offer. The intention and consideration with respect to the contract in this case are already unchallenged and it is deemed that they exist. According to the principles of Carlill v Carbolic Smoke Ball Co it can be analyzed that only if the offeror has made it clear impliedly or expressly that abiding by the terms of the offer will constitute a valid acceptance, only than acceptance of that offer could be made in this form. It was made clear by the offer that acceptance of the offer would only be made when the winning ticket is communicated to the head office of the company. Applying the legal principles of revocation of an offer discussed in step 2, it can be analyzed that the company had the right to withdraw the offer any time before the communication of acceptance was made to them. This had to be done by the company by directly or indirectly communicating the revocation to the offerees. The company did so by making radio and televisions advertisement along with publishing the notice of renovation at their head office. In the case of Amanda it can be analyzed that although Amanda committed the actions according to the terms of that contract before she could actually make the acceptance by showing the ticket to the head office the notice of revocation of the offer was made to her as she read the notice hung on the head office reception. Therefore, there was no contract between Amanda and the company and she is not entitled to get the car. It is to be noted in this situation that it is irrelevant whether or not she bought the burgers herself. In the case of Johnathon it can be analyzed that his purchase of 25 burgers and redemption of the tokens for the winning tickets did not account to an acceptance of the offer. This can be asserted because the offer clearly stated that acceptance would only be made when the winning ticket is communicated to the offeree. According to the legal principles discussed in Step 2 revocation of an offer can be made any time before an acceptance to that offer is made, such revocation can be direct or indirect. In this case the claimant presumed that he did not hear the radio and television news related to the offer, and when he reached the head office he was not able to see the notice presented their due to the crowd. It can be asserted in this case that the revocation was neither direct nor indirectly was communicated to Johnathon. Therefore without having proper notice of the revocation it can be held that the presentation of the winning ticket by Johnathon at the counter accounted to the fo rmation of a contract. However the company had already accepted the claim of another person before such communication of acceptance was made by Jonathon therefore the offer ceased to exist as it was clear in the terms of the offer that the company intended to provide only one care to a winning ticket. Step 4 Thus in this case it can be concluded that neither Amanda nor Johnathon are eligible to claim the car from the burger company as revocation through notice was made to the former claimant before her acceptance and in case of the latter the offer did not exist as it was already accepted by another offeree. The ââ¬Ëcultural imperialism thesis' caters to this phenomenon of subordination and domination1 CULTURAL IMPERIALISM THESIS We generally refer to the phrase ââ¬Ëcultural imperialism thesisââ¬â¢ to elucidate the process of deterritorialization. Deterritorialization is reducing the time and space barriers between physical territories hence restructuring the old cultural geographical and social territories.2 For that reason it is appropriate to say that cultural imperialism thesis is a comprehensive framework intended to account for this complex global cultural bu ild-up and the resulting relationships.3 The key elements that this thesis caters to are cultures that are suppressing other weak cultures. First and foremost of these dominant cultures are Western and/or American culture.4 Therefore, this thesis expounds on the strategies used to regulate, deregulate and re-regulate the domination. Often there are historical cultural events that condense a cultureââ¬â¢s value systems and its ability to overpower the other. The inequality of conditions that takes place is a key issue discussed in this thesis. This occurrence of historical dominance can be exemplified by referring to the course of colonialism that empowered Western cultures to subordinate the cultures of Asia, Africa, the Americas and certain other regions of the world. The colonisation shows the cultural superiority of the 'West over the Restââ¬â¢ because the West had a strong economy and liberal democracy that set standards for the weak cultures to follow.5 On this basis, we can say that cultural imperialism works at the conscious and the unconscious level, as it gives people the appropriate standards for their being to which they ought to identify.6 The emergence of capitalism in the Western world is another key element that is covered by the cultural imperialism thesis. Capitalism in the Western world originates from both Western and capitalist values. But when we look into examples of capitalism in Japan we see it was dictatorial to a certain extent, whereas capitalism in the UK was not. Therefore, we know that there is a difference between these. A firm's cost of capital is imperative because it represents the funds used to finance the firm's assets and operations. First you have to estimate the cost of capital in order to minimize it. In estimating the cost of capital, you first have to find the cost of each capital component and then combine the component costs to find the weighted average cost of capital. First, I calculated the cost of debt. Pepsico's bond consisted of 7 5/8 coupon rate, maturing in 1998 at a price of $1023.80. I figured the payments to be $38.15(.0763*1000/2). I then used my financial calculator to find the bond yield of 5.16% by entering in 1023.80=PV, 1000=FV, 2= N, 38.15=PMT. The bond was calculated semi-annually, therefore I multiplied the answer for I/Y times 2 to get 5.16%. The next step would be to calculate the preferred stock, however my stock had none. I then went to the third step of calculating cost of retained earnings. First I found the three growth rates which were historical, forecast, and sustainable growth. The historical and forecast annual rates I simply pulled directly from Value Line under Past 10 years and estimated years of the dividends. They both were 14.0%. The sustainable growth is calculated by taking the retention rate (b) and multiplying it by the return on equity (r ). To find b, I first calculated the dividends payout ratio which is DPS/EPS. I pulled DPS and EPS from value line under 1997. Then to find the retention rate, I subtracted the ratio from 1. Next, I calculated r, by taking net income and dividing it by net worth. These figures I also pulled from Value Line. My b= .352, and r=28.68%. Then the third growth rate was 10.10(.352*28.68). Still calculating the cost of retained earnings, I then calculated my cash flows by the discounted cash flow approach. For the first three cash flows, I took the dividend of the stock over the price of the stock, and then added the growth rate to it. My first cash flow equaled to 15.38%, second was also 15.38%, and the third one was 11.45%. To find the cash flow four, I used the CAPM approach. This formula is Ks=Krf + (Km-Krf)bs. I found beta on Value Line which was .95. The risk free rate was found by obtaining the current yield on a 20yr. T-bond from the Wall Street Journal. It equaled 6.60%. US Federal Court System Primer Often called the guardians of the Constitution, the U.S. federal court system exists to fairly and impartially interpret and apply the law, resolve disputes and, perhaps most importantly, to protect the rights and liberties guaranteed by the Constitution. The courts do not make the laws. The Constitution delegates making, amending and repealing federal laws to the U.S. Congress. Federal Judges Under the Constitution, judges of all federal courts are appointed for life by the president of the United States, with the approval of the Senate. Federal judges can be removed from office only through impeachment and conviction by Congress. The Constitution also provides that the pay of federal judges shall not be diminished during their Continuance in Office. Through these stipulations, the Founding Fathers hoped to promote the independence of the judicial branch from the executive and legislative branches. Composition of the Federal Judiciary The very first bill considered by the U.S. Senate the Judiciary Act of 1789 divided the country into 12 judicial districts or circuits. The court system is further divided into 94 eastern, central and southern districts geographically across the country. Within each district, one court of appeals, regional district courts and bankruptcy courts are established. The Supreme Court Created in Article III of the Constitution, the Chief Justice and eight associate justices of the Supreme Court hear and decide cases involving important questions about the interpretation and fair application of the Constitution and federal law. Cases typically come to the Supreme Court as appeals to decisions of lower federal and state courts. The Courts of Appeals Each of the 12 regional circuits has one U.S. court of Appeals that hears appeals to decisions of the district courts located within its circuit and appeals to decisions of federal regulatory agencies. The Court of Appeals for the Federal Circuit has nationwide jurisdiction and hears specialized cases like patent and international trade cases. The District Courts Considered the trial courts of the federal judicial system, the 94 district courts, located within the 12 regional circuits, hear practically all cases involving federal civil and criminal laws. Decisions of the district courts are typically appealed to the districts court of appeals. The Bankruptcy Courts The federal courts have jurisdiction over all bankruptcy cases. Bankruptcy cannot be filed in state courts. The primary purposes of the law of bankruptcy are: (1) to give an honest debtor a fresh start in life by relieving the debtor of most debts, and (2) to repay creditors in an orderly manner to the extent that the debtor has property available for payment. It will be argued that although international arbitration in general including ISA is not regulated by a centralized forum by which binding precedents may be created, the cumulative effect of BITs and ISAs applying and interpreting BITs have resulted in a customs, norms and rules that have established a coherent body of law applicable to standards of treatment expected of host states.8 It will also be argued, however, that despite the emerging coherent body of law, there are challenges to overcome. For example, the different language used in BITs has resulted in arbitrators rending inconsistent or unclear decisions in their interpretation of protective clauses in BITs.9 Outline: In order to support the hypothesis that ISA or international commercial arbitration has co ntributed to a coherent body of law for promulgating FDIs, the proposed dissertation will be presented as follows: Part I: Introduction. The introduction establishes that over the last 20 years or so, there have been two interesting developments in international commercial transactions: an increase in BITs10 and a decrease in investor/state arbitration.11 The introduction then makes an undertaking that the dissertation will establish that the link between these developments is ISA in that BITs provide for arbitration of investor/state disputes and interpret and apply the level of protection provided for in BITs.
